EB3: Skilled Workers, Professionals, and Unskilled Workers (Other Workers)
EB3 is the third preference process that provides lawful permanent residence in the US to professionals, skilled workers and unskilled workers with a permanent offer of employment in the US.
Requirements:
Skilled Workers:
- Must have at least 2 years’ relevant employment experience or training that are not temporary or seasonal.
- Must be performing work for which qualified workers are not available in the United States.
- In addition, a Labor Certification Process is required to demonstrate that no qualified workers are already available in the U.S. to fill the position.
Professionals:
- Must possess a baccalaureate degree, or foreign equivalent degree, that is required for entry into their occupation.
- Education and experience may not be substituted for a baccalaureate degree
- Must be performing work for which qualified workers are not available in the United States.
- In addition, a Labor Certification Process is required to demonstrate that no qualified workers are already available in the U.S. to fill the position.
Other Workers:
- Must be undertaking unskilled labor that requires less than 2 years of training or experience that are not temporary or seasonal.
- Must be performing work for which qualified workers are not available in the United States.
